Export rules and regulations in the EU
What are export rules?
EU export control rules
The European Union (EU) controls the export of dual-use and military items. These regulations require businesses within the EU to require export control licenses for the export of these goods outside of the EU. The authorities within the European Dual-Use Regulation establish several components:
- The list of controlled items;
- Criteria for granting licenses;
- General export authorization for certain goods to specific destinations.
Military goods are controlled through the Common Position on Arms Export. This system guides EU member states on policies for arms transfers. In both agreements, human rights, internal conflicts, and regional stability are crucial within the decision-making of authorities.

The new EU Dual-Use Regulation
On 9 September 2021 the New EU Dual-Use Regulation came into force. This regulation governs the export of dual-use goods (items with both civilian and military applications). It was put in place to strengthen the control the EU has over sensitive goods and technologies. This happened in the light of upcoming challenges surrounding cybersecurity, artificial intelligence and human rights concerns that followed these developments. Import features of the regulation include:
- An expanded range of controlled items
- New controls in the field of AI and cybersecurity
- Stricter export control rules
- More responsibility on companies and member states
